I acknowledge that FitCation does not include health and travel insurance in my FitCation purchase. I recognize that purchasing travel insurance for this FitCation is highly recommended, including medical and Cancel For Any Reason (CFAR) coverage. I accept that I am responsible for any loss, penalties, fees, or other financial consequences of the trip. I am responsible for choosing a travel insurance provider and assuming all risks associated with doing business with my chosen provider.

I acknowledge it is my responsibility to obtain all required travel documents, including but not limited to Passports, Driver's Licenses, Visas, and Immunization Records associated with my chosen FitCation destination. I recognize that I am responsible for booking my flights to the FitCation destination and that BSF is not responsible for problem-solving any travel issues related to my flight carrier. If I am refused entry into the FitCation destination because of inadequate or incorrect travel documents, I accept FitCation will not grant me a refund.

I grant FitCation the right to take photos and/or videos during the FitCation. I understand that these images may be used for promotional and commercial purposes, including but not limited to print materials, websites, social media, and other marketing channels.

I understand that I will not receive any financial compensation for using my likeness in any photographs or videos taken during the trip. This consent is given freely and voluntarily.

I grant FitCation the right to edit, alter, copy, exhibit, publish, or distribute these photographs and videos for any lawful purpose. I waive any right to inspect or approve the finished product.

I release any claims, demands, and liabilities that may arise from using my image, including any claims for defamation or invasion of privacy.

This consent is perpetual and will remain in effect indefinitely unless I revoke it in writing. Any revocation will not affect prior uses of my image.

We understand that plans can change. If you need to cancel your FitCation, please notify us by email. Please note that all payments made toward your FitCation are non-refundable, and you will remain responsible for the total cost of the trip unless otherwise specified in writing. If you cancel more than 90 days before your trip’s start date, you are eligible for a one-time reservation transfer to another FitCation of equivalent value. A $500 non-refundable transfer fee will apply, and any difference in price between the original and new trip will be your responsibility.

In the unlikely event that we need to cancel your trip, you will receive a full refund of any payments made. We’ll also keep you in the loop about upcoming adventures so you don’t miss out on future FitCation opportunities.

Please note that no discounts or refunds will be provided for late arrivals, early departures, or guests who choose not to participate in scheduled meals, classes, or excursions.

If you are booked in a double-occupancy room and cancel, you will be responsible for the additional cost of converting the room to single occupancy. This cost will be determined based on current rates at the time of your cancellation unless you can secure a replacement roommate.

Participants are expected to conduct themselves respectfully and responsibly during the FitCation. Misconduct includes, but is not limited to:

• Disruptive or abusive behavior towards fellow participants, trip leaders, or local residents.

• Substance abuse, including excessive consumption of alcohol or illegal drugs.

• Violations of local laws and regulations.

FitCation reserves the right to remove any participant from the trip without prior notice if their behavior is deemed inappropriate or detrimental to the enjoyment and safety of others.

If a participant is removed from the trip due to misconduct, they will be responsible for their return travel arrangements and will not be entitled to any refund for unused portions of the trip. Additionally, FitCation is not liable for any costs incurred due to early departure, including but not limited to transportation, accommodation, or any other expenses.

FitCation, its employees, shareholders, subsidiaries, affiliates, officers, directors, successors, representatives, and assigns (collectively “FitCation”) does not own or operate any entity that provides or is to provide goods or services for your trip, including but not limited to, lodging facilities, transportation companies, tour guides, food service or entertainment providers, equipment suppliers, operators of recreational, adventure, or other activities (regardless of whether such activities are included as part of the FitCation trip itinerary), babysitters or daycare providers, etc. As a result, FitCation is not liable for any negligent or willful act or failure to act by any such third person or of any other third party. In addition, I acknowledge that I have voluntarily applied to participate in the trip designated on this application (or a trip to which I may subsequently transfer). I am voluntarily participating in this trip with the knowledge of degree of physical fitness needed, whether or not mine has been disclosed to FitCation, and the numerous risks and dangers involved, including but not limited to negligence in any manner on the part of FitCation including, without limitation, negligence in the conduct or arrangement of the trip in any respect from inception to completion, negligence in the maintenance or operation of any van or other motor vehicle utilized to transport passengers, etc.; acts of God or force majeure, acts of war or civil unrest, insurrection or revolt, acts of government, strikes or other labor activities; physical exertion for which I am not prepared; negligent or reckless acts by the participant or others; forces of nature; weather conditions; transportation failures or the failure of any transportation mechanism to arrive or depart timely or safely, whether by plane, train, auto, boat or any other mode of conveyance; consumption of alcoholic beverages; risks associated with food or impure water; terrorism of the threat thereof; criminal activity; bites from or dangers associated with wild or other animals, pests, or insects; negligence or willful misconduct by third parties, breakdown or failure of any mechanical devices or equipment; financial default of any supplier; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; the adequacy of medical attention once provided; epidemics or the threat thereof; stolen lost, or misplaced luggage or property; and theft or break-ins to motorized vehicles, lodging rooms, or elsewhere. I acknowledge that the enjoyment and excitement of adventure travel is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work and that these inherent risks contribute to such enjoyment and excitement, being a reason for my participation. I HEREBY AGREE TO BE RESPONSIBLE FOR MY OWN WELFARE AND ACCEPT ANY AND ALL RISKS OF DELAY, UNANTICIPATED EVENTS, INCONVENIENCE, ILLNESS, INJURY, EMOTIONAL TRAUMA OR DEATH. 

I acknowledge that the cost of all FitCation trips is based upon participants executing this Release of Liability, Assumption of Risks, and Binding Arbitration Agreement. I agree that this Agreement shall be legally binding upon me personally, all members of my family and all minors traveling with me, my and their heirs, successors, assigns, and legal representatives, it being my intention to fully assume the risks associated with this trip and to release FitCation from any and all liability to the maximum extent permitted by law. MISCELLANEOUS MATTERS: I understand that FitCation reserves the right to take photographic or film records of any of its trips and hereby agree that FitCation may use any such photographic or film records for promotional and/or commercial purposes, as well as approve such use by third parties with whom FitCation may engage in joint marketing, without any remuneration to me. I hereby assign all right, title, and interest I may have in or to any and all media in which FitCation might use my name or likeness.I agree to follow all written and verbal rules of safety presented to me by FitCation or any of its subcontractors, agents, employees, or assigns. I understand that FitCation reserves the right to refuse as a trip participant, or remove from a trip, without refund, any person it judges to be incapable of meeting the rigors and requirements of participating in the activities, or who is abusive to other trip participants, leaders, guides, or third parties, or who it determines to detract from the enjoyment of the trip by others. FitCation reserves the right to make route, hotel, itinerary and trip modifications as required or desirable to improve the trip quality and/or to accommodate the comfort and well-being of guests. BINDING ARBITRATION: I agree that any dispute concerning, relating or referring to this Agreement, the brochure or any other literature concerning my trip, or the trip itself, shall be resolved exclusively by binding arbitration pursuant to the Federal Arbitration Act, 9 U.S.C.§§1-16, or any successor legislation, either according to the then existing Commercial Rules of the American Arbitration Association (AAA) or pursuant to the Comprehensive Arbitration Rules & Procedures of the Judicial Arbitration and Mediation Services, Inc. (JAMS). Such proceedings will be governed by substantive (but not procedural) California law without consideration of the California Arbitration Act and will take place in Concord, California, however, the California Vehicle Code will not apply to vehicular traffic outside of California. The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this Agreement, including but not limited to any claim that all or any part of this Agreement is void or voidable. By agreeing to these terms and conditions, I, as well as FitCation, waive our right to a trial by jury. KNOWING & VOLUNTARY EXECUTION: I have carefully read and fully understand the contents and legal ramifications of this Agreement as well as all the conditions as stated in the current FitCation brochures and/or website [bodysyneryfitcation.com], including but not limited to, those regarding cancellation and refund policies. Exceptions to this policy cannot be made for any reason, including but not limited to, weather, terrorism, civil unrest, labor strikes, wars, the activities of any government, personal, family or medical emergencies. I understand that this is a legally binding and enforceable contract and sign it of my own free will. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect. 

This contract is accepted by FitCation in Concord, California, on the date completed and cannot be changed in an oral communication. We can only accept one signature per form.
